Terms and conditions of sale

What you are buying, at what price, within what time, and what you can do if it does not suit you. Written to be read.

1. Purpose

These terms govern all distance sales of products concluded on nawanutrition.com between Nawa Nutrition (“we”, “the seller”) and any natural person not acting in the course of a business (“you”, “the consumer”).

They are subject to Law no. 31-08 on consumer protection, Law no. 53-05 on the electronic exchange of legal data, and the Moroccan Code of Obligations and Contracts.

In accordance with article 30 of Law no. 31-08, these terms are accessible from every page of the site and must be expressly accepted before your order is confirmed. Placing an order constitutes full acceptance of the version in force on that date.

3. The products

We sell food supplements. Each product page states the product name, composition, ingredients, packaging, directions for use, precautions and price, in accordance with article 3 of Law no. 31-08.

Food supplements are not medicines: they do not prevent, treat or cure any human disease, and are no substitute for a varied, balanced diet or a healthy lifestyle. Seek advice from a healthcare professional before use during pregnancy or breastfeeding, while on medication, if you have a known medical condition, or for a child. Do not exceed the recommended daily dose. Keep out of reach of young children.

The best-before date is printed on every pack. We never ship a product with less than six months of shelf life remaining.

Photographs represent the products as faithfully as possible; minor variations in shade or packaging that do not affect the product's essential qualities cannot give rise to liability.

All offers are subject to available stock.

4. Prices

Prices are shown in Moroccan dirhams (DH), all taxes included. In accordance with article 5 of Law no. 31-08, the displayed price is the total price payable for the product itself.

Delivery charges are shown separately and in full before you finally confirm your order:

  • Morocco: free delivery, with no minimum order value.
  • International: 180 DH, whatever the order value.

For deliveries outside Morocco, any customs duties, import taxes and clearance fees are payable by you and are neither collected nor refunded by us.

We may change our prices at any time. Products are invoiced at the price in force when your order is recorded.

5. Placing an order

  1. You add the products you have chosen to your cart.
  2. You provide your contact details and delivery address.
  3. You choose a delivery method and review the summary: products, quantities, unit prices, delivery charges and total payable.
  4. You expressly accept these terms, then confirm the order.
  5. We send you a confirmation restating all of the above.

The order is only definitively formed once you receive that confirmation. In accordance with article 32 of Law no. 31-08, it is sent to you in writing, on a durable medium, at the latest at the time of delivery.

We may call or message cash-on-delivery orders to confirm the address and that someone will be there. An order with clearly incorrect contact details, or showing serious signs of fraud or resale, may be cancelled: you are told, and you are charged nothing.

We archive orders on a reliable, durable medium. In accordance with article 34 of Law no. 31-08, the burden of proving that we met our information, confirmation and time-limit obligations rests with us.

6. Payment

Payment is made on delivery, in cash, to the courier, when the parcel is handed over. No deposit and no bank details are requested when you order.

No surcharge applies for this payment method: the amount the courier asks for is exactly the amount on your order summary.

Refusing to pay for the parcel on delivery, outside the exercise of the right of withdrawal, cancels the order. Repeated cancellations may lead us to require prepayment for subsequent orders.

7. Delivery

We deliver anywhere in Morocco within 24 to 72 hours on business days after confirmation, and to 28 countries internationally.

In accordance with article 39 of Law no. 31-08, your order is fulfilled within a maximum of 30 days from the day after you place it.

If a product turns out to be unavailable, we tell you and refund you without delay, and no later than 15 days after payment, in accordance with article 40. With your express agreement, a product of equivalent quality and price may be substituted.

8. Right of withdrawal

In accordance with article 36 of Law no. 31-08, you have 7 days from receipt of the product to withdraw, without giving a reason and without penalty.

That period is extended to 30 days if we have not confirmed in writing the information required by articles 29 and 32 of the same law.

Only the cost of returning the product remains payable by you.

Excluded products

Article 38 of Law no. 31-08 excludes from the right of withdrawal goods that, by their nature, cannot be returned or are liable to deteriorate or expire rapidly. Food supplements whose protective packaging or seal has been opened or broken after delivery are therefore excluded: a foodstuff intended to be swallowed, once unsealed, cannot be put back into circulation for food-safety reasons.

This exclusion never applies to a product delivered damaged, expired, not matching your order, or defective: see section 9.

How to exercise it

Write to contact@nawanutrition.com or message us on WhatsApp before the deadline, quoting your order number and the products concerned. We will give you the return address and confirm your request in writing.

Refund

In accordance with article 37, we refund you without delay and no later than 15 days after the date on which you exercised your right. Beyond that, the sums due bear interest at the statutory rate as of right.

As your order was paid in cash on delivery, the refund is made by bank transfer to the account you give us, or by any other means agreed with you.

9. Statutory warranties

Independently of any commercial guarantee, you have the statutory warranties provided by the Moroccan Code of Obligations and Contracts and by Law no. 31-08.

  • Warranty against hidden defects. If the product has a defect that makes it unfit for its intended use, you may ask for a replacement or a refund. In accordance with article 65 of Law no. 31-08, the action must be brought within 12 months of delivery. That period cannot be shortened by agreement.
  • Conformity with the order. A product that does not match the one ordered, is supplied in the wrong quantity, is past its best-before date or arrives with damaged packaging is taken back, replaced or refunded in full, with return costs payable by us.

Tell us about any problem as soon as you can, with a photograph if possible: it speeds things up, but your rights do not depend on it.

10. Liability

We are answerable for the proper performance of the order on the terms laid down by law.

We are not liable, however, for use contrary to the directions or precautions printed on the pack, for exceeding the recommended daily dose, for inadequate storage after delivery, or for taking the product alongside medication without medical advice.

Nothing in these terms limits the rights the law gives you as a consumer. Any clause having such an effect is deemed unwritten, in accordance with articles 15 to 19 of Law no. 31-08.

11. Personal data

The data you give us to process your order is handled in accordance with Law no. 09-08 on the protection of individuals with regard to the processing of personal data. Details are in our privacy policy.

12. Force majeure

Neither party is liable for a failure caused by force majeure within the meaning of article 269 of the Moroccan Code of Obligations and Contracts. If the impediment lasts more than thirty days, either party may terminate the order; any sums paid are returned to you.

13. Severability and amendment

If any provision of these terms is held void or unenforceable, the remainder stays in full force.

We may amend these terms at any time. The version applicable to your order is the one online on the day you confirm it; we keep it and will send you a copy on request.

14. Governing law and disputes

These terms are governed by Moroccan law.

For any complaint, write to contact@nawanutrition.com. Failing an amicable settlement, you may bring proceedings before any court with territorial jurisdiction under the Code of Civil Procedure, the court of your own place of residence, or the court of the place where the service was actually performed, in accordance with article 202 of Law no. 31-08.
